These terms (the "Terms") govern access to and use of Neexis Render, the AI rendering platform. To register you must accept them by ticking the corresponding box. If you do not agree, do not use the service. If you have questions before accepting, write to hola@neexisrender.com.
1. Who provides the service
The service is provided by Neexis Render, S.L., with Tax ID (NIF) B75924027, registered office at Calle Nueva 2, 2A, 20001 Donostia / San Sebastián (Gipuzkoa), Spain, registered at the Gipuzkoa Companies Registry, sheet SS-47909 ("Neexis Render"). The official channel for any communication or complaint is hola@neexisrender.com.
2. Description of the service
Neexis Render is a browser-based platform that lets designers, architects and other creatives upload 3D models and images, apply materials, lights and prompts, and obtain images, renders, 3D models and videos generated with artificial intelligence models.
The service runs in the cloud, at studio.neexisrender.com, and requires no installation. Some features may be experimental. We may modify, suspend or withdraw features; if the change is significant, we will give you reasonable notice.
3. Registration and account
To use the service you must:
- Be at least 18 years old.
- Provide truthful information and keep it up to date.
- Keep your password and credentials secret.
- Be responsible for whatever is done from your account.
Tell us immediately if you suspect someone has accessed your account. You can sign out of all your devices from your account. We may suspend or cancel accounts that do not meet these requirements.
4. Plans, credits and payments
Plans
We offer a free plan and paid monthly or yearly plans (Starter, Pro and Ultimate). The price, credits and features of each plan are on the pricing page and may change; a change does not affect the period you have already paid for.
Free plan
When you register you receive 3,000 credits, once, valid for renders. They expire after 30 days. Paid features (including image, editing, 3D and video) require a paid plan.
Plan credits
Each generation spends credits according to its type and quality, and the app shows you the cost before generating. Monthly plan credits renew at the start of each billing month and unused credits do not carry over. On yearly plans you receive the whole year's credits at once when you pay, and they do not carry over to the next year. Credits have no monetary value and cannot be transferred to another account, except for distribution within a classroom.
Failed generations
If a generation fails because of an error on our side or a provider's and you receive no result, the credits are automatically returned to your balance.
Credit packs
If you have an active paid plan you can buy extra credits at any time. They are one-off payments, with no renewal, and the app shows the price and taxes before you pay. Pack credits do not expire and are spent after plan credits. You need an active plan to spend them; if you cancel your plan, they are kept and you can use them when you have a plan again.
Payments
Payments are processed by Stripe. Neexis Render does not store your full card details.
Billing and renewal
Subscriptions are charged in advance at the start of each period, monthly or yearly, and renew automatically at the current price. You can cancel at any time from your account: cancellation takes effect at the end of the paid period, and you keep access until then. If you upgrade mid-period, you pay and receive the proportional difference.
Right of withdrawal
If you are a consumer, you have 14 calendar days from the purchase to withdraw without giving reasons, by writing to hola@neexisrender.com. Before paying we ask you to confirm whether you want to start using the service right away. If you confirm:
- Credit packs: once you spend the first credit of the pack you lose the right of withdrawal for it (art. 103.m of the Spanish Consumer Act). If you have not spent any, we refund everything.
- Subscriptions: if you withdraw within 14 days, we refund the amount minus the part of the service already provided, calculated from the credits spent (art. 108 of the Spanish Consumer Act).
We refund within 14 days at most, by the same payment method. Outside these cases there are no refunds, except for billing errors or serious service failures. None of this limits your rights if the service does not conform to what was contracted.
Taxes
Prices on the website are shown without VAT. Before paying you will see the VAT applicable to your country and the total. If you buy as a business with a valid EU VAT number, VAT is applied according to your country's rules. Every invoice itemises taxes.
Price changes
If we change the price of your plan, we will notify you by email 30 days in advance. The new price applies at the next renewal, and you can cancel before then at no cost.
5. How to contract
To contract: 1) choose a plan or a pack, 2) review the summary with the final price, 3) accept these Terms and confirm whether you want to start using the service right away, and 4) pay with Stripe. Before paying you can go back and correct any detail. We keep a record of what you accepted (date and version of the texts) and you can ask us for a copy. The contract is concluded in Spanish or English, depending on the language you choose. We confirm every purchase by email.
6. Acceptable use
You agree not to use the service to:
- Generate or distribute content that is illegal, defamatory, infringes third-party rights, is sexual involving minors, or promotes violence, hatred or discrimination.
- Impersonate people or companies, or falsely claim authorship of a work.
- Upload models, images or materials you do not hold sufficient rights to, such as third-party models with an incompatible licence or trademarks without authorisation.
- Upload photos of people without their permission, or generate images with them that harm their honour, privacy or likeness.
- Create realistic images or videos of real people that make something false appear true without indicating they are made with AI.
- Reverse-engineer, mass-scrape, aggressively automate or use the service beyond its reasonable purpose.
- Circumvent technical limits: credits, usage limits or the marks that indicate content is AI-generated.
- Distribute malware, attack the infrastructure or compromise the security of other users.
If you break these rules, we may suspend your account immediately and, where appropriate, take legal action.
7. Your content and licences
Your content remains yours
You retain ownership of the models, images and data you upload, and of the results you generate from them, to the extent the law allows ownership of works created with AI assistance.
Licence you grant us
To process your files you grant us a worldwide, non-exclusive, royalty-free licence limited to what is strictly necessary to: a) store your content, b) process it with AI models, c) display it to you on the platform and d) deliver it to you for download. It does not allow us to use it for marketing, to train AI models, to publish it or to sell it, unless you give us written permission.
No AI training with your content
Neexis Render does not use your content to train AI models, neither its own nor third parties', and only works with providers whose paid terms prevent them from training on it. More details in the Privacy Policy.
Images of real people (avatars and reference photos)
Some features let you upload photographs of people (for example, to create an avatar with the features of a real person, or as a reference for an edit). By uploading a photograph showing an identifiable person and pressing "Generate", you represent and warrant that a) you are the person shown, or b) you have obtained that person's express consent (or that of their legal representative, if a minor) to use their likeness for that purpose.
When you generate, Neexis Render records your confirmation (date, accepted text, IP address and a digital fingerprint of each photograph) as evidence of this statement. Reference photographs are not kept: they are used only to produce the result and are deleted afterwards; only their fingerprint is stored.
You are solely responsible for the use of third parties' likeness. Neexis Render, S.L. is released from any liability arising from the upload or use of photographs of people without the required authorisation, and shall not be liable, to you or to any third party, for any claims, damages, penalties or costs (including legal fees) resulting from it. You agree to hold Neexis Render, S.L. harmless against any claim by the person shown or by third parties, in accordance with section 13. Neexis Render may remove the affected content and suspend the account upon any sign of breach.
Neexis library
You may use the library's materials, backgrounds, styles and models within your results, including for commercial purposes. You may not download, resell or distribute them separately.
8. AI-generated results
Results are produced by AI models and may contain artefacts, geometric inaccuracies or differences from what you asked for. We do not guarantee a specific result. Review them before using them commercially (catalogues, offers, customer communications) and comply with the rules of your sector.
Images generated with Google's models carry an invisible watermark (SynthID) indicating they were generated with AI; other providers may include similar marks or metadata. Do not remove them. If you publish a result that realistically shows real people, places or events, you must indicate that it has been generated or manipulated with AI (Regulation (EU) 2024/1689, art. 50).
9. Education
Student licences and classrooms are governed by these Terms and by what we agree with the institution or the teacher. All students must be at least 18 years old. The teacher who creates a classroom can distribute credits among their students with a code and see their usage within the classroom. Distributed credits are only valid within the classroom and while the course licence lasts. Student licences are for educational, non-commercial use.
10. Service availability
We try to keep the service available at all times, but we do not guarantee a specific percentage unless we sign it in a separate contract. There may be outages due to maintenance, provider failures, security incidents or force majeure. We will give reasonable notice of scheduled outages, in the Studio itself or by email.
11. Suspension and cancellation
By you: you can cancel your subscription at any time from your account, and ask us to delete your account by writing to hola@neexisrender.com, as explained in the Privacy Policy.
By us: we may suspend or cancel your access if a) you breach these Terms, b) your use poses a security or legal risk, c) payment is not completed despite reasonable reminders or d) we close the service. Except in cases of serious breach, we will give you reasonable notice and refund the proportional part of the unused period.
12. Warranties and liability
If you are a consumer, you have the legal guarantee of conformity for digital content and services (arts. 114 et seq. of the Spanish Consumer Act), and nothing in this section limits it.
If you are a professional or a business, the service is provided "as is" and "as available". To the extent permitted by law, we are not liable for indirect damages, loss of profit, loss of data or third-party claims, except in cases of wilful misconduct or gross negligence. Our total liability to you is limited to what you paid us in the 12 months before the event giving rise to the claim.
13. Indemnity
If you use the service as a professional or a business, you agree to hold Neexis Render, S.L. harmless against third-party claims caused by a) your breach of these Terms, b) your unlawful use of the service, c) the rights to the files you upload or the results you generate with them, or d) the use of real people's likeness in photographs you upload or in avatars, images or videos you generate (section 7), including claims for image rights, privacy, honour or data protection. If you are a consumer, you are liable for the damage you cause in accordance with the law.
14. Changes to these Terms
We may change these Terms for legal or security reasons or because of changes to the service. We will notify you by email at least 30 days in advance and tell you what changes. If you do not agree, you can cancel before they take effect, at no cost. If you keep using the service afterwards, the new Terms apply.
15. Governing law and jurisdiction
These Terms are governed by Spanish law. If you are a consumer, you may bring claims before the courts of your place of residence. In all other cases the courts of Donostia / San Sebastián (Gipuzkoa) have jurisdiction.
